This Privacy Notice explains how Discovery Communications LLC. and/or its subsidiary and affiliated entities (“we,” “us,” “our” or “Discovery Communications LLC”) collects, uses, and discloses information about you (“user” or “you”) through https://discovery.apexportal.net/ (the “Site”) for the purpose of registering companies or individuals who are currently or wish to be considered as a supplier of goods and services or talent (each, a “Supplier”) to Discovery Communications, LLC or one or more of the subsidiary or affiliated companies of Warner Bros. We reserve the right to make changes to this Privacy Notice from time to time. If we make changes, we will alert you about any changes by updating the “Last Updated” date of this Privacy Notice, and in some cases, we may provide you with additional notice (such as adding a statement to our homepage). We encourage you to review the Privacy Notice whenever you access the Site or otherwise interact with us to stay informed about our information practices and the choices available to you.
1. Collection and Use of Information
When you interact with the Site, we collect information that directly identifies you (i.e., information that would allow someone to identify you or contact you, such as your full name, postal address, e-mail address, or telephone number), as well as information about your use of the Site. Below we describe the different types of information we collect from you and the devices you use when you interact with the Site.
Information you provide to us: The Site allows you to enter contact information, tax, billing and other information about yourself and your company. We collect and store any information you enter through the Site. For example, you may provide:
- Your first and last name, title, business e-mail address, business address, business phone number and preferred language so that we can contact and communicate with you;
- Supplier name or trade name; Supplier classification, category and sub-category; and, if applicable, Deal Vendor ID number, so that we can register you in our Supplier systems;
- Supplier tax country; tax type, tax identification number, withholding tax type, withholding tax code value, recipient type, withholding tax number, withholding tax exemption number, withholding tax exempt percentage and withholding tax exempt reason, to determine the correct tax requirements when we compensate you or your company for your services;
- Supplier billing information such as payment methods, bank country, bank account number, payment currency, bank swift code, IBAN number, CLABE number, ABA routing number, bank code, account holder name, bank account type, bank name, bank street address, so that we can credit your account with payments; or
- Your e-mail address, communications, and files when you send to us a message by e-mail.
When you access or use the Site, we automatically collect the following information from you:
- Log Files: As is true of most websites, we may gather certain data automatically and store it in log files. This includes session IDs, user IDs, IP addresses, browser versions, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, preferences and clickstream data. We use this information to analyze trends, to administer the Site, to track users’ movements around the Site and to gather demographic information about the Site’s user base.
- Cookies: A “cookie” is a small text file that may be used to collect information about your activity on the Website. For example, when someone visits a page on the Site, a cookie is placed on the user’s machine (if the user accepts cookies) or is read if the user has visited the Site previously. We use cookies to identify our users and recognize you when you return to the Site. Cookies also enable us to customize user experiences on the Site. We may link the information we store in cookies to any personal information you submit while on our Site.
- Web Beacons: We and our service providers may employ a software technology called web beacons that help us better manage content on our Site by informing us on what content is effective. Web beacons allow us to count users who have visited certain pages of the Site and to analyze traffic to our Site. We also use web beacons in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our affiliate marketing campaigns.
2. How We Use the Personal Information We Collect
We use the information we collect to provide and improve the Site, to collect Supplier information for onboarding, tax and accounting purposes, and to communicate with you.
We may also use the information we collect to investigate and help prevent potentially unlawful activity or activity that threatens the network, to enforce our policies and procedures, and to protect our rights and intellectual property as well as the rights of others using our Site.
3. Sharing of Information
- We may share information we collect with our service providers who need access to such information to carry out work on our behalf to operate or maintain the Site;
- In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities; and
- In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company.
4. Your rights
Under certain conditions and where provided by applicable law, you have the right to request that we: (a) provide access to any personal information we hold about you; (b) update any of your personal information which is out of date or incorrect; (c) delete any personal information which we are holding about you; (d) restrict the way that we process your personal information; (e) prevent the processing of your personal information for direct-marketing purposes; provide your personal information to a third party provider of services; (f) provide you with a copy of any personal information which we hold about you; or (g) consider any valid objections which you have to our use of your personal information.
We will assess any request to exercise these rights on a case-by-case basis. There may be circumstances in which we are not legally required to comply with a request because of relevant exemptions provided for in applicable data protection legislation. If you are based in the EU, EU law requires us to provide you with additional information regarding your personal information and your rights, as follows:
- Data controller. The data controller in respect of your information is Discovery Communications LLC., registered in Delaware in the United States of America whose registered office is at 230 Park Avenue South, New York, NY 10003, United States.
- EU Representative. Our EU Representative is Discovery Communications Benelux B.V. whose registered office is at Kraanspoor 20, 1033 SE, Amsterdam, Netherlands.
- Data Protection Officer. You can contact our Data Protection Officer by emailing DPO@discovery.com.
- Transfers outside of the EEA. We may transfer your information to countries outside of the European Economic Area (“EEA”), for the above purposes. If we do this, we will, as legally necessary:
- include the EU standard contractual data protection clauses approved by the European Commission into our contracts with the recipients; or
- ensure that the country in which your personal information will be handled has been deemed “adequate” by the European Commission under the General Data Protection Regulation.
